1. About these terms

These terms apply to the Afiyets mobile app and the website at afiyets.com (together, "Afiyets"), provided by Afiyets ("we," "our," or "us"). By creating an account or using Afiyets, you agree to them. If you don't agree, please don't use Afiyets.

Our privacy policy explains how we handle your data and forms part of these terms.

2. Who can use Afiyets

You must be at least 16 years old to use Afiyets. By using it, you confirm that you are.

3. Your account

You can sign in with Google or Apple, or use Afiyets as a guest. A guest account lives on your device: if you delete the app or lose the device before upgrading to a full account, your data may be lost. You're responsible for what happens under your account and for keeping access to your sign-in method secure.

You can delete your account at any time from Settings in the app. See deleting your account.

4. What Afiyets does

Afiyets helps you keep track of places you've saved, mark where you've been, rank places by comparing them two at a time, and discover new places that suit your taste. We're always improving it, so features may change, be added or be removed over time.

5. Plans, subscriptions and payment

Plans

Afiyets is free to use with limits. Plus and Pro are optional paid plans that raise those limits and add features, as described in the app at the time you subscribe. Monthly allowances, such as Discover runs, refill on your billing date and don't carry over. To keep Afiyets fast and reliable for everyone, fair-use limits also apply to how often some features can be used in a day.

Billing and auto-renewal

• Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), and paid through your store account.
• Plus and Pro are available monthly or yearly. The price is shown in the app, in your local currency, before you buy.
• Your subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Your store account is charged for the renewal within the 24 hours before the period ends.
• You can manage or cancel your subscription in your store account settings at any time. On iPhone: Settings → your name → Subscriptions. On Android: Google Play → Payments & subscriptions → Subscriptions.
• If you cancel, you keep your plan until the end of the period you've already paid for.
• Deleting the app or your Afiyets account does not cancel your subscription.

Free trial

Plus Annual may include a free trial, shown in the app before you start it. If you don't cancel at least 24 hours before the trial ends, it converts to a paid subscription and your store account is charged the annual price. A free trial is available once per store account. Any unused part of a free trial ends when you buy a subscription.

Changing plans

You can switch between Plus and Pro, or between monthly and yearly, from the app. Your store decides when the change takes effect and handles any credit for time you've already paid for.

Price changes

We may change subscription prices. Apple or Google will tell you about a price change in advance and, where required, ask for your consent before it applies to your subscription.

Refunds

Because payments are handled by Apple or Google, refund requests are made to them and decided under their policies: on iPhone at reportaproblem.apple.com, on Android through your Google Play order history. This doesn't affect any rights you have under consumer law where you live.

6. Your content

The places, rankings, notes and photos you add stay yours. You give us permission to store and process them only as needed to run Afiyets for you. When you delete something, or your account, we delete it as described on our account deletion page.

Only upload photos you have the right to use, and don't add content that is unlawful, offensive, or infringes anyone else's rights.

7. Place information and Google Maps

Place details in Afiyets, such as names, addresses, photos, ratings and price ranges, come from Google Maps and from what you enter yourself. Parts of Afiyets use Google Maps features and content; your use of them is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

We don't control or guarantee this information. Places close, move and change. Suggestions from Discover are suggestions, not endorsements: check a place's details before you go, and always confirm allergy and dietary information with the restaurant directly.

When you share a post or link to Afiyets from another app, we read it only to find the places it mentions.

8. Using Afiyets fairly

You agree not to:

• use Afiyets for anything unlawful
• copy, scrape or resell Afiyets or its content, including place data
• try to get around plan limits, fair-use limits or security measures
• reverse engineer, disrupt, or overload Afiyets or the services it relies on
• access Afiyets by automated means

We may suspend or close an account that breaks these terms. Where reasonable, we'll tell you first and give you a chance to fix the problem.

9. Our rights

Afiyets, including its design, name, logo and software, belongs to us or our licensors. We give you a personal, non-transferable, non-exclusive licence to use the app for your own non-commercial use, under these terms. Nothing else is licensed to you.

10. Disclaimers

We work hard to keep Afiyets running well, but we provide it "as is" and "as available." We don't promise it will always be available, error-free, or that any place will meet your expectations. We aren't responsible for restaurants or other venues, or for your experience at them.

11. Limitation of liability

To the extent the law allows, we aren't liable for indirect or consequential losses, or for loss of data, arising from your use of Afiyets. Our total liability to you for any claim is limited to the amount you paid us for Afiyets in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer.

12. If you downloaded Afiyets from the App Store

These terms are between you and us, not Apple. Apple is not responsible for Afiyets or its content, and has no obligation to provide maintenance or support for it. If Afiyets fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation for Afiyets. We, not Apple, are responsible for any claims relating to Afiyets or your use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, and claims that it infringes someone else's intellectual property.

You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when you use Afiyets, such as your mobile carrier's. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Changes to these terms

We may update these terms from time to time. If a change is significant, we'll let you know in the app or by email before it takes effect. If you keep using Afiyets after that, you accept the updated terms.
